These Terms of Use (“Terms”) are a legal agreement between you and Ruslan Safargaleev (“we”, “us”) governing your use of the Onestly mobile application and this website (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance of terms
By downloading, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into a binding contract.
3. License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for your own personal, non-commercial purposes, subject to these Terms and the Apple Media Services and App Store terms. You may not copy, modify, reverse-engineer, resell, or distribute the App except as permitted by law.
4. Subscriptions & payments
- Some features require a paid subscription. Pricing and the billing period are shown in the App before you purchase.
- Subscriptions are sold through Apple’s In-App Purchase and billed to your Apple ID. Payment is charged at confirmation of purchase.
- Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Manage or cancel your subscription in your Apple ID settings (Settings → [your name] → Subscriptions). Deleting the App does not cancel your subscription.
- Refunds are handled by Apple under the App Store terms; we do not process refunds directly.
- Apple’s standard Licensed Application End User License Agreement (EULA) also applies: apple.com/legal/internet-services/itunes/dev/stdeula.
5. Acceptable use & prohibited content
You agree not to use the Service to:
- upload or process content that is unlawful, or that you do not have the right to upload;
- upload content depicting or concerning anyone under 18;
- upload other people’s private information in violation of their rights or applicable law;
- harass, stalk, threaten, or harm any person, or use analyses to do so;
- attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
- use the Service for any commercial screening, background-check, or profiling purpose.
We may suspend or terminate access for violations.
6. AI analysis disclaimer
The App uses AI to generate analyses, scores, and suggestions. These are automated, may be inaccurate or incomplete, and are provided for informational and entertainment purposes only. They are not professional advice of any kind — not psychological, medical, legal, safety, or relationship counseling — and are not a background check or a guarantee about any person. You are solely responsible for your own decisions and interactions. Always use your own judgment and prioritize your safety.
7. Third-party services
The Service is not affiliated with, endorsed by, or sponsored by any dating platform (such as Tinder, Bumble, or Hinge) or any other third party whose content you may upload. All trademarks belong to their respective owners. Your use of third-party services is governed by their own terms.
8. Intellectual property
The Service, including its software, design, and content (excluding your content), is owned by Ruslan Safargaleev and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.
9. Your content & license to process
You keep ownership of the content you submit. You grant us a limited license to host, process, and transmit your content solely to operate the Service and provide your analyses, as described in the Privacy Policy. You represent that you have the rights necessary to submit your content.
10. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that analyses will be accurate or reliable.
11. Limitation of liability
To the maximum extent permitted by law, Ruslan Safargaleev will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of (or inability to use) the Service or your reliance on any analysis. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.
12. Indemnification
You agree to indemnify and hold harmless Ruslan Safargaleev from any claims, damages, or expenses arising from your content, your use of the Service, or your violation of these Terms or any third party’s rights.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for legitimate operational or legal reasons. Provisions that by their nature should survive (for example, disclaimers, limitation of liability, and indemnification) survive termination.
14. Governing law
These Terms are governed by the laws of Cyprus, without regard to its conflict-of-laws rules, subject to any mandatory consumer-protection laws of your country of residence.
15. Apple-specific terms
You acknowledge that these Terms are between you and Ruslan Safargaleev only, not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or consumer-protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist-supporting”, and that you are not on any U.S. Government restricted-parties list.
16. Changes to terms
We may update these Terms from time to time. We will revise the “Last updated” date and, for material changes, provide notice. Continued use after changes means you accept the updated Terms.
